General Terms and Conditions of Use and Sale

PREAMBLE

The websites www.wherever-travelS.COM, www.wherever-travelS.PRO, and the mobile application "Wherever Travel Agency" (hereinafter referred to as the "Platform") are operated in the People's Democratic Republic of Algeria by Wherever Travel Agency, a Limited Liability Company (SARL) with a share capital of [to be inserted] DZD, registered under the Trade Registry number 16/02 - 0544746 B 21, and holding the Tax Identification Number (NIF): 00213905447465216002. The company's registered office is located at Villa 189, Coopérative Bois des Cars 03, 16320, Dely Brahim, Algiers, Algeria.

The Platform is dedicated to the online booking of airline tickets, stays, accommodations, land transportation, and related or ancillary tourism services.

These General Terms and Conditions of Use and Sale (hereinafter "GTCUS") govern the access, navigation, and use of the Platform by any user or customer.


DEFINITIONS

  • Wherever Travel Agency: refers to the publishing and operating company of the Platform.
  • Client or User: refers to any natural or legal person using the Platform to consult, book, or purchase services.
  • Services: refer to all services accessible via the Platform, including but not limited to the booking and purchasing of airline tickets, stays, travel insurance, land shuttles, and other travel-related services.
  • Partner: refers to any external service provider (airlines, hotels, carriers, insurers) with whom Wherever Travel Agency has signed a service agreement.

ARTICLE 1: ACCEPTANCE OF GENERAL CONDITIONS

Any use of the Platform implies the full, unconditional, irrevocable acceptance of these GTCUS by the Client.
In the event of refusal, the User must refrain from accessing the Platform's services.

Wherever Travel Agency reserves the right to modify the GTCUS at any time; the applicable version is the one in force at the time of booking or purchase.


ARTICLE 2: ACCESS AND USE OF THE PLATFORM

Access to the Platform is restricted to persons of legal age (18 years and older) and with legal capacity to contract.
The User guarantees the truthfulness of the information provided during account creation or booking.

The following are strictly prohibited:

  • Using the Platform for fraudulent, speculative, or abusive purposes.
  • Attempting to alter the proper functioning of the Platform.
  • Attempting to access unauthorized or restricted data.

Wherever Travel Agency reserves the right to refuse or suspend access to any User in case of violation of the GTCUS, without any compensation.


ARTICLE 3: INTELLECTUAL PROPERTY

The Platform and its content (texts, logos, images, graphic charters, databases, software, etc.) are protected under applicable intellectual property laws.
Any unauthorized reproduction, extraction, exploitation, or representation is strictly prohibited and may result in legal action.


ARTICLE 4: PERSONAL DATA PROTECTION

Wherever Travel Agency undertakes to respect the confidentiality of collected data in accordance with Algerian data protection legislation.
Data are hosted exclusively on servers located in Algeria.

They are used for booking management, service improvement, and targeted marketing campaigns.

Data will not be shared with third parties without express consent unless required by law.

The Client has the right to access, modify, and delete personal data by submitting a written request to Wherever Travel Agency.


ARTICLE 5: TRANSACTION SECURITY

Payment transactions are secured by SSL (Secure Sockets Layer) protocol and managed by certified providers (SATIM, Algérie Poste).
Wherever Travel Agency does not store the Client’s banking data after the transaction.

Any payment fraud attempt may result in notification to the competent authorities and immediate account termination.


ARTICLE 6: BOOKING AND PURCHASE PROCESS

To validate a booking:

  • The Client must provide accurate personal data.
  • Must expressly accept the GTCUS.
  • Must make immediate payment or choose delivery payment under specific conditions.

A reservation is confirmed only after full payment validation. A confirmation email is systematically sent.

Wherever Travel Agency is only bound by an obligation of means regarding the immediate availability of displayed services.


ARTICLE 7: PRICING AND PAYMENT METHODS

Displayed prices are in Algerian Dinar (DZD), inclusive of all taxes (TTC), excluding potential additional fees (delivery, insurance).

Available payment methods:

  • Edahabia card (Algeria Post)
  • CIB interbank payment card
  • Cash on delivery under specific conditions

Wherever Travel Agency reserves the right to cancel any order in case of manifest pricing errors or non-payment.


ARTICLE 8: LIMITATION OF LIABILITY

Wherever Travel Agency cannot be held responsible for:

  • Modifications or cancellations imposed by its partners (airlines, hotels, etc.).
  • Indirect damages such as loss of profit, data, or reputation.
  • Temporary unavailability of the Platform due to maintenance or force majeure.

In any case, Wherever Travel Agency’s liability for proven direct damage is limited to the amount paid by the Client for the concerned service.


ARTICLE 9: RETENTION OF OWNERSHIP CLAUSE

Services remain the property of Wherever Travel Agency until full payment is received.

In the event of non-payment, Wherever Travel Agency may suspend or cancel any reservation without prior notice.


ARTICLE 10: TICKET DELIVERY

  • Home delivery possible only for amounts below 150,000 DZD.
  • Delivery to relay points is mandatory for amounts above that threshold.

Wherever Travel Agency shall not be held responsible for reservation cancellations due to the client’s unavailability during delivery or non-payment.


ARTICLE 11: APPLICABLE LAW AND DISPUTES

These GTCUS are governed by Algerian law.
Any dispute relating to their interpretation or execution shall be submitted to the competent courts at Wherever Travel Agency’s registered office.

Before any judicial action, the parties agree to seek an amicable resolution.


ARTICLE 12: MISCELLANEOUS PROVISIONS

If any provision of these GTCUS is deemed null or unenforceable, the other provisions shall remain fully in force.


ARTICLE 13: FORCE MAJEURE

Wherever Travel Agency shall not be liable for partial or total non-performance of its obligations due to a force majeure event, as defined by Algerian law, including but not limited to: natural disasters, wars, riots, internal or external strikes, major Internet failures, epidemics, transportation blockages.

In such cases, Wherever Travel Agency commits to informing its Clients as soon as possible.


ARTICLE 14: USER RESPONSIBILITY

The User is solely responsible for:

  • The accuracy of information provided on the Platform.
  • Compliance with local or international travel and stay regulations.
  • Keeping their login credentials secure.

Wherever Travel Agency disclaims all liability for input errors by the User resulting in damages (reservation losses, additional costs, boarding refusals, etc.).


ARTICLE 15: FRAUD PREVENTION

Wherever Travel Agency reserves the right to:

  • Refuse or cancel any suspicious or non-compliant order.
  • Request additional identity and residence proofs before validating any booking.
  • Report any suspected fraudulent activity to the authorities.

No refunds will be made for orders canceled due to proven fraud.


ARTICLE 16: LOYALTY PROGRAM (Optional)

Wherever Travel Agency may, at its sole discretion, offer loyalty programs such as points, discount vouchers, or customer benefits.

Membership, use, and expiration terms will be detailed in a specific regulation available on the Platform.

Wherever Travel Agency reserves the right to modify or cancel any loyalty program without prior notice.


ARTICLE 17: CUSTOMER SERVICE

For any complaint or request for assistance, the Client may contact Customer Service:

  • Via the contact form available on the Platform.

Claims must be submitted within 7 days of the disputed event; otherwise, they will not be considered.


ARTICLE 18: EVIDENCE AGREEMENT

The User acknowledges that Wherever Travel Agency’s computerized records (orders, payments, electronic communications) constitute valid, admissible, and opposable evidence.

These elements may be produced in court in case of dispute.
